# TERMS OF SERVICE AGREEMENT

## 1. INTRODUCTION AND ACCEPTANCE OF TERMS

1.3 Nothing in this Agreement is intended to limit your statutory rights as a consumer under the laws of the **United Arab Emirates**, specifically **Federal Decree-Law No. 15 of 2020 Concerning the Regulation of Consumer Protection Rights**. However, where these Terms provide additional protections or clarify commercial understandings, they shall apply without waiving your statutory minimums.

## 2. NATURE OF GOODS AND PRODUCT DISCLOSURE

**2.1 Material Composition:**  

The Customer explicitly acknowledges and agrees that all items sold on this platform are categorized as **Fashion Jewelry**. Unless otherwise explicitly stated as "Solid Gold" or "Solid Platinum", all gold-colored items are constructed with a base metal alloy (e.g., Brass/Copper) electroplated with a thin layer of KGP (Karat Gold Vermeil) or similar non-precious alloy.

**2.2 Wear and Tear Disclaimer:**  

As with all plated items, prolonged exposure to moisture, perfumes, lotions, or physical friction may result in natural wearing of the top plating over time. The Company does not represent any item to be permanent, solid gold, or investment-grade bullion.

**2.3 Care Instructions:**  

Customers are expected to follow care guidelines provided with the product (e.g., remove before swimming, sleeping, or washing hands) to preserve the integrity of the gold plating. Failure to follow basic care standards that results in product degradation voids warranty claims.

## 3. INTELLECTUAL PROPERTY RIGHTS

3.1 **Ownership:** All content on the Website, including but not limited to product photography, logo designs, branding elements ("BlingArabia"), descriptions, and code, remains the exclusive intellectual property of **Tazah Global LLC** or its licensors.

3.2 **Restrictions:** You may not copy, modify, distribute, transmit, or broadcast any Content without express written permission from Tazah Global LLC. Reverse engineering, web scraping, or attempting to utilize our imagery for affiliate schemes is strictly prohibited and subject to legal action under UAE Copyright Law.

## 4. PRICING, PAYMENT, AND TAXES

4.1 **Currency:** All prices displayed are in United Arab Dirhams (AED).

4.2 **Taxes:** Unless otherwise stated, listed prices **exclude the Value Added Tax (VAT)** at the rate of 5%. VAT is calculated and added at checkout in compliance with Federal Decree No. 40 of 2022 (UAE Executive Regulations for VAT).

4.3 **Payment Processing:** We utilize third-party payment gateways that comply with PCI-DSS standards. Tazah Global LLC does not store your credit card information directly on our servers. Authorization fees or failed transaction holds are managed according to the policies of the acquiring bank.

## 5. CUSTOMER ACCOUNTS AND ELIGIBILITY

5.1 **Minimum Age Requirement:** By creating an account or placing an order, you represent and warrant that you are at least **18 years of age**. Minors require parental consent.

## 6. LIMITATION OF LIABILITY AND DISCLAIMERS

**6.1 Medical and Allergen Warning:**  

Many users with metal allergies (specifically to nickel, copper, or nickel-cadmium alloys often found in base metals for fashion jewelry) are advised to proceed with caution. **Tazah Global LLC** accepts no liability for adverse skin reactions, rashes, or allergic responses resulting from prolonged skin contact with our jewelry. Customers with known hypersensitivity should verify material safety data sheets prior to purchase.

**6.2 Color Accuracy:**  

While we strive for digital accuracy, monitor settings and screen calibrations vary. Colors may appear different across devices. A variance of up to 10% in color temperature compared to the physical unit is considered normal.

**6.3 Consequential Damages:**  

To the fullest extent permitted by UAE Law, Tazah Global LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use the Site or products.

## 7. GOVERNING LAW AND JURISDICTION

7.1 **Applicable Law:** This Agreement shall be governed by and construed in accordance with the federal laws of the **United Arab Emirates**. Specifically, this agreement falls under the scope of the **UAE Penal Code** (for fraud/consumer protection violations) and **Federal Decree-Law No. 15 of 2020 (Consumer Protection)**.

7.2 **Conflict of Laws:** In the event that any term of this Agreement is held invalid, illegal, or unenforceable for any reason whatsoever, the remaining portions shall remain in full force and effect.

## 8. DISPUTE RESOLUTION

In the spirit of amicable commercial relations, both parties agree to attempt to resolve any controversy or claim arising from this Agreement amicably before resorting to litigation.

8.1 **Amicable Settlement:** In the event of a dispute, the Parties agree to consult each other and cooperate to negotiate a settlement in good faith.

8.2 **Arbitration/Litigation:** If an amicable resolution is not reached within fourteen (14) days, either party may refer the matter to the competent courts of the **Emirate of Dubai or Sharjah**, where the company maintains its principal place of business and records.

## 9. MODIFICATIONS TO TERMS

9.1 **Right to Amend:** Tazah Global LLC reserves the right to review and revise these Terms of Service at any time. Any changes made effective more than thirty (30) days after the Effective Date of revision are deemed to relate to existing contractual relationships. 9.2 **Continued Usage:** Your continued use of the Site after posting changes signifies your acceptance of those changes.
